    GENERAL
    This fertile block of land is about 300 yards to the south of the attractive village of Fetterangus, and 2 miles north of the town of Mintlaw. Peterhead is about 10 miles east, Fraserburgh about 11 miles north and Aberdeen about 30 miles to the south.

    DIRECTIONS
    From Mintlaw, take the A952 road north from the town and after about 1 mile take the left fork which is signposted to “Fetterangus 1 mile”. Follow this road for about half a mile and the entrance to Netherbrae will be seen on the left-hand side, on a sharp right turn in the road. There is a good hard track running between the two blocks of arable land which also gives access to the house at Netherbrae which is in separate ownership and not included in this sale.

    DESCRIPTION
    The land at Netherbrae extends in total to about 41.03 acres and comprises a block of arable land extending to about 34.37 acres together with 2 areas of rough grazing which extend to about 2.76 acres and 3.90 acres.
    The land is about 150 feet above sea level. The arable land has mainly light sandy loam soils and the land is classified as Grade 3(2) by the James Hutton Institute. Grade 3(2) land is defined as being capable of average production, but high yields of barley, oats, and grass are often obtained.
    The arable land is fallow in 2014. A good hard road runs through the centre of the property and provides good access. The public road also borders part of the land on the east. The rough grazings can be improved and will be of interest to purchasers looking for grazing ground for horses and ponies and other livestock. Fences need to be erected along some of the boundaries.
    For the convenience of potential purchasers, the land is being offered for sale either as a whole or in up to 4 lots as follows:

    LOT 1 outlined red on the sale plan - Fertile Arable land extending to about 14.53 acres with frontage to the public road.

    LOT 2 outlined blue on the sale plan - Fertile Arable land extending to about 19.84 acres with access directly from the public road.

    LOT 3 outlined orange on the sale plan - Rough Grazing’s extending to about 3.90 acres.

    LOT 4 outlined green on the sale plan - Rough Grazing’s extending to about 2.76 acres.

    BOUNDARY FENCES
    In the event of a sale in lots, the purchasers of Lot 3 and Lot 4 will be required, at their own expense, to erect a stock proof fence around each lot within 3 months of the date of entry. Once erected the future maintenance of these fences will be shared with the neighbouring proprietors.

    ACCESS ROAD
    In the event of a sale in lots, the purchaser of Lot 2 which includes the solum of the access road, will be bound to provide a right of access for all purposes to the purchasers of lots 1, 3 & 4. Netherbrae Cottage has a right of access over the track and a share of its maintenance. Maintenance of the shared access road will be according to user.

    ENTRY & VACANT POSSESSION
    Immediately upon completion of the sale at a date(s) to be mutually agreed.

    DEVELOPMENT CLAWBACK
    The purchasers of the whole, or each individual lot, will be required to enter into a Clawback and Overage Agreement with the sellers, backed by a Standard Security in favour of the sellers, for a 33.33% share of any increase in value of the land above agricultural value as a consequence of planning permission being granted for a nonagricultural use of all or part of the land at some future date.

    OFFERS

    CLOSING DATE
    A Closing Date for offers may be fixed and prospective purchasers are advised to register their interest with the sole selling agents following inspection of the property. The seller reserves the right to sell the property without fixing a closing date or prior to the closing date. The seller will not be obliged to accept the highest, nor indeed any offer. The seller will not be liable for any costs incurred by interested parties in connection with their interest in the property.

    LOTTING
    It is intended to offer the property for sale as described but the seller reserves the right to divide the property into further lots or to withdraw the property or to exclude any property shown in these particulars.     In addition to the purchase price, the purchasers of both Lots 1 & 2 will be required to take over and pay for, at a separate and additional valuation to be agreed between two valuers, one acting for each party, who will, failing agreement appoint an oversman, or failing agreement as to that appointment by the Chairman for the time being of the Royal Institution of Chartered Surveyors (Scottish Branch) the following:
    Lots 1 & 2 - Any growing crops at cost of cultivations, seeds, and fertilisers plus an increment for growth

    SERVITUDE RIGHTS, BURDENS & WAYLEAVES
    The property will be sold subject to and with the benefit of all servitude rights, burdens, reservations and wayleaves or any other third-party rights howsoever constituted. The property is sold subject to the rights of public access under the Land Reform (Scotland) Act, 2003.
    In the event of a sale in lots, appropriate rights will be reserved and granted at the discretion of the selling solicitors.

    DEPOSIT
    A Deposit of 10% of the purchase price of the whole or each lot will be paid to the seller by the purchaser within 7 days of conclusion of missives.
